Personally, I kind of agree with this one.  Wal Mart tries to put out this family image, when in reality they're nothing but a blood sucking corporate giant.

I love Wal-Mart, I hate the fact that I can't buy the music I want there, you can buy 'R' rated movies though.

Let me get this straight.

WalMart violated an internal policy and offered (and apparently continues to offer) for sale a recording with explicit lyrics.

Dumb parent purchases said recording and somehow suffers damages of $74,500.  Outraged dumb parent seeks a court order requiring WalMart to pull offensive recording from its shelves.

How did dumb parent suffer $75K damages?

Why should a court order WM to enforce an internal policy?

The part of the story I like:

He dismissed Whitcomb's suggestion that Wal-Mart stores didn't know about the censored version of the song. "They are a multimillion-dollar corporation and they certainly can communicate among their various entities," he said.


I had to chuckle at that one.  The bigger the company/ conlgomerate, the less the one side knows about the other.

Wow... if 2 instances of a certain 4 letter word that begins with 'f' causes $80,000 in damages... then I must have caused $999,999,999,999,999,999,999,999,999,999,999,999,999.99
of damage - yeah, I've got quite the colourful vocabulary.

I really would love to see these silly lawsuits go the way of the dodo though, as it really pains me that people seem to be too overly sensitive towards such trivial things.  Of course, it is a sign of the times somewhat.   ::)

Like Paz points out you can buy "M rated games", "R rated" movies, but they refuse to sell anything with a "Parental Advisory" label ???
WalMart is the most contridictory company known to man. I wrote them a letter once asking why it is that they sell "R" movies but refiuse to sell music with labels, they replied that

"it was easier to keep minors from buying the movies."

How is it easier? Both are labeled in the same type manor, the scanner won't ring up a sale before asking for age, Hell I get carded just to buy paint! I just don't see thier point, a child will be exposed too much worse by any movie they sell than and record they buy.

And you notice they never put that much effort into "offensive lyrics" they only go by the "label",  for instance you can still by Pink Floyd albums there, where many of you know the word "bullsh*t" can be heard on the song Money, how about the Who? "Who the Fu*k are you?", that is for sale.
The most recent album I bought from WalMart is Ted Nugent's Full Bluntal Nugidty (which I highly recommend ;) ) , let a parent listen to the first ten seconds of that and they would have WalMart shut down, LOL!!!

Seems that most artist fall into a "grandfathered law" and only what the kids of today might listen too are targeted and they let everything else slide. It is all crap too me.

Label on the album or not it is censorship, and it is wrong!!!


Once again another parent blaming someone else for not "protecting" thier child! And now wanting to be paid for it.
If you have kids or want them take the damn responsiblity of "protecting" them yourself and stop hindering the rest of the world with your crap lawsuits, ban this and ban that attitude and YOU get involved in your childs life and control what the see, read, hear, say etc. !!!
I didn't ask for or want your kids and I don't want to feel that I have to be concerned about what they are exposed too, so don't go forcing your concerns about "the children" in my face. Why should I let someone elses child predict what I'm allowed to do, say, hear, watch etc ?
Leave the rest of us alone, if you want us or the Government or WalMart to be concerned with protecting your child so you don't have to be bothered with it because we all know you are just too busy to handle it yourself, put your willy in a wrapper the next time you feel the urge. ;)

Unfortunately we are going down the same road here in the UK. Blame others for your own misfortune and don't take any responsiblility for your actions.
Parents constantly blame teachers ... social services... the police...  etc etc etc for letting little Johnny get into trouble, watch the wrong T.V. programme or buy the wrong video game. They then complain that the teachers... police.... social services etc etc etc haven't got the resources to deal with real problems.

Dumb parent's lawyer probably figured $75k was a small enough number that WalMart would rather pay than go to court.   Tort law in the US sucks.  IMO it's the greatest economic threat this country faces.

The reason I refer to them as a "blood sucking giant", is becasue in many cases when they have a store in one area they won't think twice of placng another a few miles away.
This hurts the "small businesses", stores that might have been in a area for years and locals depended on and trusted can't compete against WalMart because they don't have the buying power that WalMart does. This causes many family owned businesses, businesses that a family depends on to survive, raise thier children and send them to school etc, to shut down.
They will tell you the WalMart can provide a communitiy jobs, yes it can but it doesn't matter how many jobs when it pays on a pay scale at poverty level.

So WalMart moved in to town and I got a job!! Yippee to bad that it is $4 less a hour than Henderson's Clothing that was forced to shut down. Sure am glad they came ;)

Another thing is with the buying power of WalMart then they should have more items made in the US, that would help our economy, but no they can get crap made elsewhere for less. Well I'm more than happy to pay a little extra for something made here, because I know by doing so I'm helping someone to keep thier job, I'm helping the economy etc.
In the long run WalMart is a big factor the Job Outsourcing problem that the US faces, along with Automotive Manufacturers, and Textile Manufacturers, it is the "heads" of big corporations looking to put more change in thier pockets that is causing the whole unemployment problem in the US and it all starts at a place like WalMart the retailer who is the one that sells the items that manufacturers make ;)
So WalMart bringing a few hundred jobs to one area is really affecting 1000's of jobs elsewhere.

And Paz you of all people here should know what effects of outsourcing jobs can have, after all your in the automotive manufacturing area, and you know that your job might be gone at any time without notice and a Union can't stop that from happening ;)

I think Walmart should go to court over this, pay these idiots the $75,000 and then take them to court and sue them $100,000 for the trauma of being sued.  ;D

As far as kids hearing the "F" word, they might as well get used to it, as soon as they start school or go to work they will not only hear it many times a day but will most likely be using it themselves, it's just a word, it's not the word that is bad, it's the fact that someone decided it should be a bad word, it's all stupid.

I have to agree that the whole concept of swear words is stupid but thats how it is. You must also agree that the so-called "F-word" (I'm not even allowed to spell it on this forum but everyone knows what I mean) is all too often used in music & films either to deliberately shock or by untalented "artistes" who are too illiterate to think of a better alternative. Swearing doesn't offend me. I can cuss with the best of 'em, & often do, but I never did in front of my ex-wife or daughter & object to being subjected to profanity in my own home under the pretext of entertainment. If I want to listen to swearing & profanity I can visit my old workplace & hear more than enough in a few minutes to last me a week.

I often wonder what we would do for swear words if the current ones were judged acceptable for everyday use. It seems that we need something a little more powerful to use when ordinary words are insufficient. ::)
