Like Eno says any photo taken by you is your property, and as long as it isn't used for "commercial" purposes then you can publish and receive a small fee for it.


The minute money changes hands, doesn't that make it commercial?

But you're using their copyrighted logo to make a profit.  It's like if I wanted to use a song in a TV show.  I wouldn't be able to use it for free because I had a copy of the CD...

I'm no lawyer, but I would assume a good loophole would be, you took a photo of the aircraft, and not of the logo which just so happened too be there??? Or the case may be made that the photo was of another object (sky, building etc) and the airplane just happened to appear.
Just to hard in my opinion to sue over something like this.

I always wondered this, started when I had my wedding photos done. I couldn't make copies for family because they were the property of the photographer, even though they were photos of me and my wife!

This is where things start getting silly. If it's taken to extremes nobody would be able to use anything without permission from countless interested parties. This usually involves contracts & payments of some kind. It's exactly what I meant by my earlier comment about lawyers. I would rather leave it alone before we stir up a hornet's nest. ;D

I think you're missing my point Pip. Maybe I didn't explain it properly. What I mean is that if I take a photo of anything (as an amateur) I feel within my rights to make as many copies as I wish & do exactly as I like with them. I don't want to go round every possible owner of a sign, shopfront, advert, aircraft logo or whatever happens to be in that photo & get permission to use it. The way things are these days I already feel obliged to ask anyone that might be in the shot for their permission before taking it - especially if they have children with them. This usually ruins the shot completely as they start posing which is exactly what I don't want. ::)

I think the whole point is that .... If you take a picture you have the right to do with it as you wish... even charge someone for the pivilage of using it... and if you find that someone is using it without your permission then you have the right A. ask them to stop using it and B.charge for its use. The content of the picture is irrelevant unless it breaks the law.  ::)

Eno got it about right. I'm sure this is the way it works.
I wonder about the situation with these mobile phones that double up as digital cameras & goodness knows what else. Anyone with one of these things can take a photo of anything without anyone knowing about it. They can also send it to anyone via e-mail using the phone. So much for privacy & security. ::)


The authorities are already onto this one and they're trying to bring in some sort of law/code of practice @ least here in the UK ... but once again its technology outpacing the lawmakers.
