is there a way for those of us whose parents bought us the standard edition of FSX for Christmas can get the sdk?

Yes, I believe though 'SDK' comes stored on the disk or if it is, it would be on disk1 I presume. Then the required plug ins would be provided by Microsoft.

Legally - No.
The SDK is on dvd 1 of the deluxe edition, as you know by now, and although the SDK SP1 is downloadable, it looks to see that you have the "first" SDK installed.

I don't suppose that there is a way to upgrade to deluxe? preferably legally.

The only way I know is to buy it.
Who knows, maybe they'll inlcude the SDK as part of FS-X:Adrenaline
