Justice???

Postby OldAirmail » Tue Dec 17, 2013 9:57 am

Does it exist?

Four killed and two injured. One of them paralyzed for life, and unable to speak.

Ethan Couch, the rich kid whose ‘affluenza’ defense helped him avoid jail time, is being sued

"He’s got a mean case of “affluenza” and now five people are hoping to dole out a bit of legal medicine."

Ethan Couch — the Texas brat who dodged jail time after killing four people while driving drunk using the defense that his spoiled upbringing made it impossible for him to exercise normal judgment...

I hate most of the "sue everyone" mentality, but in this case - YES.

If his parents are responsible for him being so spoiled that he couldn't understand that he was doing was wrong, then they are responsible for the deaths and injuries.

Think about it this way. A poisonous snake can't be legally held culpable for biting someone. But if you let it loose in a daycare center then YOU are the guilty party.

Psychologist Dick Miller, a name to remember.

"Couch’s outlandish — but effective — defense, garnered national headlines. The doctor that took the stand to defend the spoiled kid said that Couch was better off in rehab than in prison."

I'm sure that a great many criminals would agree that this applies to them too.

I doubt this is going to work out as well as predicted.

Wealthy people buy significant insurance coverage for this reason. I wouldn't be surprised if the insurance company hasn't already offered to pay the policy limits. This should cover dad's exposure to compensatory damages (as owner of the vehicle).

They can't get anything out of the kid even if they are able to get a huge judgment for punitive damages. Sixteen year olds don't own much. Holding dad and his business liable for punitive damages is a pretty big stretch.

Shoot,.. where I come from, as far as punitive damages goes, if the punk ain't 18, it automaticly falls on mommy and daddy's head.
and johnny law don't care one iota about how it's going to negatively affect the parents.

Now jail? that's a whole different story. ,,, Quote "Your soul better belong to jesus boy,.. Cause yo azzz belongs to ME!"

Actually, I think that this whole thing will teach him a lesson.

If you kill a bunch of people, hurt others, and paralyze someone.....

Your parents will be disappointed with you.

It would serve him right if he didn't get a new Xbox this Christmas.

In my view anyone without a conscience about causing something like this, must be some kind of psychopath.

Psychopathy (or sociopathy) is defined as either an aspect of personality or as a personality disorder, characterized by enduring dissocial or antisocial behavior, a diminished capacity for empathy or remorse, and poor behavioral controls or fearless dominance.

I suspect this story will not rest until justice is done.
