I am just curious about Prepar3D and consumer use?

Can i use this for consumer entertainment unlike what the EULA says?I knew what the FAQ says.

No, Lockheed Martin does not offer Prepar3D for entertainment, and we have no plans to enter the entertainment space. The EULAs explain that Prepar3D can be used for purposes other than personal/consumer entertainment.

Is this any thing to worry about and will i get in legal trouble for using it for consumer entertainment and can i still use it for entertainment like i do with other flying simulators?And dos the Academic License have a download limit and do i have to renew the license I purchased like a subscription?And is it worth trying if i have FSX?And do i have to start the aircraft from cold to dark?I am just curious.

The EULA clearly states that it's not licensed for entertainment. Many do the wink-wink-nudge-nudge and ignore the licensing requirements. I know I don't qualify, so I don't use it. FSX meets my needs anyway, and it runs great, looks great, on my rig.

Lockheed has said they have no plans to move P3D into the entertainment/consumer market and, I believe, their legal agreements with Microsoft will prevent that from ever happening.

YES. Lockheed Martin is very clear about their policy. Prepar3d is for many uses, BUT not for entertainment/gaming. Period.

Microsoft did not sell the rights for entertainment use. If LM started to sell Prepar3d for gaming, a lot of lawyers would make a lot of money. And LM would loose.

In so far as gaming is concerned, that's pretty much the end of the story. Finito.



That does not mean that you can not use it!

You simply can not use it for entertainment.



Much is made about how Prepar3d should be used in training & education.

This is from the General Questions, NOT the EULA.

BUT THERE'S MORE

End User License Agreement (EULA)

An "End User License Agreement" is like a contract. It states Lockheed Martins' requirements, and what you can, and can't do.

A salesman can promise you that if you buy the car he's selling, girls will throw themselves all over you. But it's the contract that counts.

Or the EULA, in this case.


Here is the important part

"The EULAs explain that Prepar3D can be used for purposes other than personal/consumer entertainment."

But it does not define, or limit, those other purposes, beyond the entertainment restriction. (We're not discussing other limits such as making copies, etc.)


From that EULA

1. License Grant. Subject to the terms and conditions of this EULA, Licensor hereby grants Licensee a fully paid-up, nontransferable, nonsublicensable, nonexclusive license during the Term of this EULA to use the Software, but only on no more than one computer at any one time, only by no more than one user at any one time, and only for purposes other than personal/consumer entertainment."


and only for purposes other than personal/consumer entertainment."

That means not for PERSONAL entertainment.
&
That means not for CONSUMER entertainment.


NOWHERE in the EULA does it say that you must be enrolled in formal/institutional classes.

NOWHERE in the EULA does it restrict you from using Prepar3d for self study.



Strangely enough, I really am using Prepar3d for self education.

Honest. I really am.

Where I might get into trouble is because I've always enjoyed learning. Sixty plus years, and I still enjoy learning.

I was that little twit who wanted to look through the textbook on the first day of class.


In the end, the EULA trumps everything.

What really surprises me is that the EULA is so clear and simple.

Being entertained is a completely subjective experience.......Some folk are entertained by the X factor (do you believe that?), others by opera......some enjoy body piercing, others enjoy being sat on by fat ladies. Some folk enjoy being beaten up and even pay for it.

As Old Airmail said above, Education entertains many folk, it is enjoyed.


Most definitions in the dictionary are dependant on the intent of the provider....Is it provided as entertainment? LM are clear about that, NO, so the legal obligations are fulfilled....How you personally experience P3D is entirely up to you and no amount of legal wording can legislate on how you feel at the time of usage.

I'm laughing my wottsits off now because my Wife, who is in the medical profession, has just mentioned that when the licenses for Viagra were being issued it had a stipulation "Not to be used for recreational purposes".

Paul, it looks like you've already used Prepar3d as an educational use too.

You've used what you know of it, to decide that you don't want it.


According to the EULA, you're fine on that point.

HOWEVER! Having learned that lesson, you are in violation of that EULA for not having paid for Prepar3d.

Lockheed Martin has a message on it's way to you, to teach anyone else a lesson.

You use it, you pay for it.


Go a head, enjoy your last flight over the west coast.

A quick browse through that;..."Eee-You-Ell-Ay"..thingy, long ago, quickly convinced me that Prepar3D wasn't meant for my sort of use...
