You want a law suit?

I cant remember exactly when this was but there we go.

A guy was walking when he saw another man struggling in a highly flooded and fast flowing river.  So the guy dived in to help the guy out, pulled the drowning man to the side of the river and called an ambulance.

As it turned out the guy drowning was attempting to commit suicide and was then hurt as a result of the man trying to save his life... so he took the guy to court and sued him for it!

I get the feeling many of these stories are blown out of proportion, or simply untrue. What judge, in the right mind, would favour the side of the suicidal man in this situation?

That's a story line stolen from the movie The Incredibles, only it was a man jumping from a building saved on the way down by a superhero.

Similar to this has actually been encountered in the medical profession but when something went wrong, often unavoidably.

There was actually a court case on this, it is similar to that from the incredibles but it is actually true.

The judge obviously did not favour the suicidal man, but still, who does that?

From what I know of tort law, the plantif is required to minimize damages.  For example, if your neighbor's pool overflows and starts emptying in to your basement you are required to minimize the damage by shutting off his hose, informing him of the situation, maybe trying to route the water away from your house, etc.

So if someone prevents your suicide and you sue, aren't you then legally required to commit suicide as soon as possible?

Do you have to be so drastic as cutting off his hose -- can't you just help him repair his toilet?
