A lot of times I hear people around the local airport talking about this law in Texas.  They say that it is legal to put a working gun on an airplane.  Is that true?

i believe there is nothing stopping licensed people taking them on light aircraft, if you want to say go hunting somewhere and you want to fly instead of drive and so on, i am not 100% sure on that but i do remember reading something along those lines.

Who would want or need to take a "non working" gun anywhere ?

(outside of transporting an antique or something)

Thats why I said working, people have "non working" guns on restored aircraft.  Like this, sort of, I saw a restored P-51 in a classified add and it said it was restored completely, all 6 .50s worked.  You could load a couple belts in and go "cow tipping" at the local ranchers farm.    Could you do something like that in Texas?  Just not shooting anybody's anything.

The best person to ask on this would be Oso as he is from Texas and knowledgeable about firearms.
I would imagine that on a private aircraft there are no restrictions, however on a commercial flight I'm sure its NOT permitted after certain events a couple of years ago

I'm from Texas, and I'm pretty sure there is no law against taking firearms onto a light aircraft, but I'm not positive. I also can't see anything wrong with the P-51 thing as long as nobody or nothing is hurt.

Haven't you heard of the Second Amendment?

You can take a gun anywhere you want as long as there isn't a law saying you can't, like (federal) commercial (interstate) aircraft, military installations, courthouses, (state) bars (one of the few wise gun restrictions I've seen), courthouses, etc.

And gun laws are subject to the Second Amendment.

Florida's gun laws are about as unrestrictive as Texas, but you can't carry a concealed weapon without a permit.

I don't want to get off on a rant here ...

But the federal government royally screwed us when it forced passage of the 14th amendment.  The original US constitution was intended to grant and restrict powers of the federal government.  State governments were free to enact their own gun control and other laws, even laws "in violation" of the Bill of Rights - since the Bill of Rights and the entire federal constitution only applied to the federal government.

After passage of the 14th amendment state govermments found themselves bound by federal government restrictions.

If it weren't for the 14th amendment a liberal state like New York could totally ban guns and a conservative state like Alabama could totally ban abortions.

Of course this is just my opinion, I could be wrong.

Can't own a machine gun in the US without special permit. Or barrel is plugged with solder or de-activated in some manner. Some military stuff is excepted with special permit as well - gotta make movies ya know.

The difference is in the flight. Commercial or private. Doubt if many would hijack a plane that only has 3 or 4 people aboard.

Not being American, I can't very well comment on your laws or Constitution.
However it seems to me there are two discussions going on here and no-one has mentioned the difference.

There is 'carrying' or 'placing' a gun onto a private or commercial plane - and then there is "INSTALLING" a working (I believe full auto's are illegal even in th US) as part of an aircraft.

I can't see anything in stopping me, for instance, taking my handgun onto a private plane here in Australia where the laws are far more stringent, so long as I have the ownser permission. But I could never get it onto a commercial flight.

As for full Auto Machine guns on a 'Warbird' - the first, and only question, from authorities and the public would have to be - 'Why do you need them working, what is the 'necessary purpose' involved here??

I would imagine the necessary process for working guns on your warbird would be straffing your annoying neighbours house..... Maybe thats why I can't get a permit
As for hijacking Oso, it'd depend on who those 3-4 people were...... Again my neighbours and certain relatives creep onto my list

I imagine these days the autorities would be a bit averse to permitting working machine guns just so that movies could have their realism.
After all, they can insert all kinds of effects and graphics so that things look better than real. I can't see few muzzle flasshes and a bolt slamming back and forth being good enough reason for a movie production company to get a machine gun permit.

But then we are talking about the US and Hollywood...........lol

(P.S. I don't know if you're aware but the rest of the world has a 'saying', albeit affectionate. "It could only happen in America!).................  ;D j/k
