It is called being civil about it.  I suspect that this stuff is illegal... but I want to be certain.  I thought my intentions for asking the questions were veryclear from what I said.

If he produces a document that supposedly has this info for me... I will try to purchase it if he'll ship to the USA.  I'll then look at the EULA's and contact all the appropriate authors on it as best a I can and make sure that they actually DID authorize the release.

EBay has a special section for the actual copyright holders to deal with violations.  So the authors have a different level of legal support from EBay.

I just got a response from the second ebay seller.  It was about 7 or 8 words long with typos and said something like 'read the bottom of the ad, it is clear enough'.

About what I expected.  It's now up to to the Ebay folks to investigate.

Just for the record Sparky, you seem to be bleating on about how it's ok for this guy to sell the freeware files, because he's only charging for the materials used (discs, postage etc).

But this is a quote from one of the ebay adverts:

So if some of the planes are freeware, then obviously the others must be payware, & as we all know, coying any payware software for mass distribution is piracy.

By buying the disk you would publically, be showing the world that you have willingly purchased stolen/pirated goods. Not the best move to make for someone who claims never to make mistakes.

I'm pleased to report that................

........ early this morning the second guy's auction on EBay for the CD containing the "suspect" FS addons we have been discussing had something like 2 days and X hours left on it........ and now as of 3:35 PM on Sunday... the listing has "ended".  I checked the hisroty......... and the "two available" are still "available" out of the original listing.

I have been a seller on EBay.... ending auctions early is frowned upon and is for a limited number of reasons.

Piracy is stealing. Stealing makes one a thief. In English law if you knowingly receive stolen goods then that makes you part of the crime too. I'm not saying this would apply here at all, all I am saying is that if the police had enough time on their hands he'd be thrown before the judge. Sadly the nations of the world have more pressing needs like dealing with murderers than "petty" thieves.  
I'd like to make two observations:

1) Obviously Sparky hasn't spent 50 hours,100 or 250 hours or whatever hours it takes desiging, creating, advertising and uploading aircraft and FS features. He certainly isn;'t appreciating that these people did it for free and this man has taken them and in flagrant beach of law sold them in the only place he is likely to get away with it - on ebay.
Remember anyone reading this, if you support crime - you are part of crime and you are a criminal.

2) This site expresses its abhorrance for those who do such things and take part in the encouragment of piracy. If you are part of that clear off. You are not wanted. There is no soft line when it comes to crime, so if you don't like the rules, express your views with those who may share them with you, but not here.  

Now, I'm not sure Sparky how serious you are, so I am speaking generally and necessarily to you personally.

Anyway, well done again John! Raising the standard! 8)

To Add one other thing to this debate...

Stuff like this can hurt Payware Companies too..

Even if it's advocated as stuff which is freeware if the Person Pays for it...well Pay+Ware makes payware...what if some of the goods in the packages dissapoint? or even worse aren't delivered? That might prevent potential Customers from buying from REAL Payware companies! (And yes I know not all payware stuff is great) Freeware IS Freeware and that's it. Paying for it in any way to obtain it is is illegal without consent by the developers.

Just my 2 pennies.......Got Pounds to spare......

Ok, NOW I am stepping back into this debate with full force.

I have just read the entire description of the Ebay package and I am now surprised to see the Ferrari being included. I clearly state in the "Read-Me" file that the Enzo Ferrari package be kept posted ONLY in any LEGITIMATE FREEWARE SITE.

This is what I feared that could happen to this addon that me and Chuck made together.

Just to be clear, what the heck does "P&P" mean exactly?
